Hajimeli Derivative Works Policy & Terms of Use
At Hajimeli, we understand that a lot of people are interested in creating fan content for things they enjoy, so we've written up these guidelines surrounding derivative works relating to our projects.
These are subject to change at any given time.
What's Allowed / Not Allowed?
The following content is allowed by this policy.
- Fan-made artwork (fanart), as long as it is safe for work (not 18+)
- Fan-made writing (fanfiction), so long as it is safe for work (not 18+)
- Fan-made music (in the case of referencing songs used in the games)
The following content is prohibited by this policy.
- Fan-made programs and content intended to replicate or replace any aspect of vivid/stasis (polymorphite will also be included in this once it has been released)
- NSFW (not safe for work) content or content involving any kind of nudity or sexually explicit depictions
- Content that infringes on the derivative works guidelines / terms of service of other products and properties
- Content that promotes hate speech or discrimination of any kind, including but not limited to racism, transphobia, homophobia, sexism, etc.
- Content that makes use of "Web3" technology (i.e. cryptocurrency or NFT)
- Content that makes use of generative AI / GenAI / GPT
Fan Merchandise
Fan merchandise related to the characters/story/gameplay of Hajimeli's projects is not strictly prohibited, but there are some guidelines that must be followed.
- You may not sell any fan merchandise relating to Hajimeli's projects on any online/digital storefronts.
Physical locations such as art booths at conventions are permitted, as long as you run it by Cheryl first.
You can contact me at cherylstelli (at) hajimeli (dot) com by email. - Any fan merchandise that is being sold at any cost is not permitted to contain any materials from the Hajimeli projects themselves, including but not limited to direct assets, screenshots, audio, store page graphics, etc.
Community Rhythm Game Content
Regarding the usage of Hajimeli original songs in other community rhythm games (i.e. osu!, Quaver), there are some guidelines that must be adhered to.
The following process must be followed before fanmade content in other games can be made.
- Check the Community Permission List. This is a spreadsheet that details which songs have granted permission from Hajimeli to be used in other games.
A number of songs have been disallowed due to personal importance to the story of vivid/stasis. - Get the artist's permission.
Even if the song you want to chart is listed as Allowed on the above sheet, you still need individual artist permission.
Look for a way to contact the artist, or, if the game you're charting for has a whitelist system like Rhythm Doctor or A Dance of Fire and Ice, check that the artist is not listed as not being allowed. - If the game you're intending to chart for violates another property's terms of service (i.e. unlicensed modded content for a game), you are not allowed to chart the song for it even if you have the above two permissions.
There may be some gray area cases that aren't covered here; if you have a question, please leave a comment on the linked spreadsheet.
Modding & Datamining
There have been some instances in the past of people asking about datamining and modding our games, so this section serves to clearly illustrate our stance on the matter for each of our games.
vivid/stasis
Datamining the game content is allowed as the game's story has finished development.
Modifying game data is a little trickier due to copyright and usage rights. Despite this, some game modifications are permitted. Please follow the guidelines to ensure you're following them. Failure to do so will result in your removal from official Hajimeli spaces.
- Any modifications are done to the offline version of the game downloadable from the vivid/stasis page on this website
- Any modifications done do not infringe on the usage rights and copyright policies of other companies or individuals
The following game modifications are allowed by this policy:
- Mods that use fan translations and localizations to make the game available in languages other than English
- Mods that add custom features to the game like custom courses, titles, and challenges
- Mods that add custom areas to Betweenspace
- Mods that add new settings and options to the game
- Mods that optimize the game's performance
The following game modifications are prohibited by this policy:
- Any game mods that would break the prohibited content in the "What's Allowed / Not Allowed" section
- Mods that add extra songs to the game (mods that add new charts for existing songs are okay) (please see below for rationale!)
- Mods that allow cheating on networking services (already prohibited by modding only being allowed on the Offline version, but worth mentioning as its own prohibition)
- Mods that replace any existing content in the game (replace existing official charts with new ones, for example) (an exception to this is fan translation mods)
- Any game mods applied to the Steam version of the game
Regarding custom rhythm game charts, we understand that this is a very wanted addition to the allowed mods; however, due to copyright, we can't officially support it. There's too much potential for breaking other companies or individuals' usage rights and causing a whole legal nightmare for Hajimeli. There's also the angle that we do not want vivid/stasis to gain popularity off of charts that aren't officially created by the team and align with the team's vision for the charting direction of the game. We are sorry that we cannot support this; please understand.
